Abstract | Hermeneutics (ta'wil) as an epistemological conception and scientific method plays a central role in Islamic intellectual history, not only in tafsir but also in Islamic jurisprudence and legal principles (fiqh and usul al-fiqh). Using relevant classical and modern literature, the present article examines closely the often conflictive field of fiqh, hermeneutics, and discourse. To begin, the concepts of discourse and hermeneutics in the title are considered from the perspective of intellectual history and summarized analytically. Subsequently, the thesis is scrutinized whether, and if so to what extent, fiqh is a discourse of hermeneutics. Amongst others, the classical usul contributions of Imam ash-Shafi'i (d. 202/820) in his ar-Risala are discussed, along with those of the renowned philosopher and intellectual Mohammed Abed Al Jabri (d. 2010) in his Takwin al-'aql al-'arabi'. |
