Abstract | "Chuck" is a 10-year-old student residing in an unnamed District ("the District"), identified as eligible for specially designed instruction because of a specific learning disability. His parents' due process complaint (filed in December 2008) requested compensatory education for the period September 2006 to June 2008. They believed that Chuck, who has an IQ of 114, did not receive meaningful educational benefit because the District failed to remediate his learning disability in a timely fashion. In addition, they held that the untimely evaluation process prevented him from receiving interventions that could have helped him to catch up to grade level. The parents believed the District was negligent in its Child Find obligation and therefore they were due compensatory education. This article discusses Chuck's case, its hearing, and the decision made by the court on his case. (ERIC). |
