AbstractThe West Virginia Department of Education has crafted this document to offer policy guidance to teams and Section 504 committees in providing appropriate access for students in statewide assessments; and to assist teachers and schools to work within the framework of federal law and state policies. The guidelines are referenced by West Virginia Board of Education (WVBE) Policy 2340, West Virginia Measures of Academic Progress; WVBE Policy 2419, Education of Exceptional Students; and WVBE Policy 2417, Regulations and English Language Proficiency Standards for English Learners; as such, this document is an addendum to the above-mentioned state policies. The purposes of the "Guidelines for Participation in West Virginia State Assessments" (Participation Guidelines) include the following: (1) providing policy guidance to individualized education program (IEP) teams, Section 504 committees, and English learner (EL) committees for appropriately accommodating students in statewide and district-wide assessments; (2) helping teachers and schools work within the framework of federal law and state policies; and (3) providing information for documentation of implementation and assurances for federal requirements under the Every Student Succeeds Act (ESSA 2015) which has replaced requirements within the Elementary and Secondary Education Act (ESEA) enacted in 2002. This document includes requirements set by the Individuals with Disabilities Education Improvement Act of 2004 (IDEA 2004).
