AbstractAs a hybrid between a college or university student and an elementary or secondary school employee, the student teacher is in a special situation. The potential for being a plaintiff (the party who sues), the defendant (the party who is sued), or a third party that is integrally involved in a lawsuit is higher because the bodies of law pertinent to both students and employees apply, the intersections of these bodies of law are complex, and the student teacher is typically inexperienced in not only the teaching profession but also the law. Legislation in each state provides colleges and universities with authority to include student teaching as a compulsory component of teacher preparation programs. Considering the importance of student teaching as a final and key phase in the preparation of the future teachers of the nation's schools, this article provides a brief sampling of the legal issues and concepts of interest to future educators generally and student teachers specifically. This paper presents a case from each phase of student teaching: 1) admission to student teaching, 2) conditions of student teaching, and 3) dismissal from student teaching. (ERIC).
