AbstractThe potential intended and unintended impact of parental rights initiatives on public education and child welfare agencies and on existing laws demands further scrutiny of the legislation and of its proponents and their motivations. Proponents assert that parental rights initiatives would guarantee parents' rights to direct the upbringing of their children and would protect parents from the encroachment of federal and state governments into childrearing. Parental rights initiatives proceed on three tracks: (1) state constitutional amendments such as that proposed in Colorado; (2) federal 'parental rights' amendments, such as the Parental Rights and Responsibilities Act; and (3) proposed state statutes, such as those in Washington, Indiana, Kansas, and New Hampshire. However, parental rights initiatives would provide individuals with legal weapons to challenge public school curricula and child abuse protection laws and would jeopardize the ability of social service agencies to act effectively in child abuse cases. These initiatives are part of a larger right-wing assault on public education to pave the way for school voucher programs and is led by two national organizations, Of The People, and the American Legislative Exchange. Parental rights initiatives, especially the Parental Rights and Responsibilities Act, raise serious concerns about their potential negative impact on investigations of child abuse and neglect, the ability of children and youth to obtain needed health care and counseling, the degree to which they would aid parents who want to censor school curricula and library collections and their facilitation of the introduction of school vouchers.
