Abstract | This chapter reviews collective bargaining cases in education during 1986. Although the courts addressed a broad range of topics, no new legal principles were applied in these cases. The courts relied on traditional labor law concepts and applied them to the specific statutes and policies of the applicable jurisdiction. The review addresses the following issues: constitutional issues; authority to bargain; recognition and representation issues, including determination of bargaining unit and elections; rights and obligations of exclusive bargaining representatives; scope of bargaining, including mandatory, permissive, and prohibited topics of bargaining; grievability and arbitrability issues; judicial review of arbitration awards and employment relations board rulings; impasse and dispute resolution; strikes and other job actions; and other miscellaneous decisions arising from labor disputes.
