Abstract | This paper provides information on the Family Educational Rights and Privacy Act of 1974 (part of Public Law 93-380) and on the regulations that govern its implementation. This act (also called the Buckley Amendment) provides that parents or students 18 or older be given the right to review student records, to have a hearing to challenge the content of student records, and to insert a written comment about a student record. Board of education policies from several school districts that were written to meet the requirements of this law are included as samples. The first two sections of this publication cover the text of the law and definition of terms. The last four sections present illustrations of procedures for annual notification of parents or eligible students of their rights to review student records, procedures governing requests for access to student records, procedures to follow regarding the disclosure of personally identifiable information to third parties, and procedures for informing parents and eligible students that a record of disclosure will be maintained with student records.
