Abstract | The Buckley Amendment, formally entitled the Family Educational Rights and Privacy Act of 1974, grants parents the right to review all records that schools maintain on their children, and to force the removal of any inaccurate or misleading data. Its major impact on educational research is linked to its provision requiring written parental permission prior to the collection or release of personal data to outsiders. The purpose of this paper is to discuss the chronology of legislation and judicial decisions relative to confidentiality of data and the release of research information, along with the implications each may have to educational research. Indepth attention is focused on the implications the Family Educational Rights and Privacy Act has for educational researchers. Finally, a discussion of what the future may hold for educational researchers is discussed. (Author/DEP) |
