AbstractIn view of the vehement discussion presently taking place in the field of higher education policy concerning the object, justification and admissibility of (general) tuition fees, it is examined whether and, if so, within which limits to be observed tuition fees could be introducted. A closer examination reveals that, in principle, international, Community and constitutional law would allow the introduction of tuition fees. As the Federal system of the German Constitution assigns jurisdiction in this matter to the Federal states as a result of their educational autonomy, a prohibition of tuition fees issued by Federal law would be unconstitutional. However, the states have their limitations: tuition fees must be necessary for safeguarding the university system in financial respect, they must be based on adjective law foundation, keep within a reasonable level, take into consideration the social situation particularly of students living in financially poor conditions and may not discriminate against foreign students from EC Member States in comparison to domestic students. Further, only individual states as a whole may introduce tuition fees. In contrast, differences between universities regarding tuition fees may not be made when different universities within one state and the same subject are concerned. Therefore, the decision as to whether tuition fees should be paid during the basic studies cannot be left to the universities, neither on the merits nor in terms of amount. (DIPF/orig.).
