AbstractIslamic legal principles (qawa'id fiqhiya) are general premises that contain normative evaluations that apply to a variety of particular legal cases. In Islamic law (fiqh), they are recognised as basic principles, most of which were derived by later scholars through inductive study of earlier legal material. Scholarly work on legal principles has increased noticeably in recent decades. A glance at some of the legal works and legal opinions (sing. fatwa) of contemporary scholars and legal committees shows the high level of interest in legal principles in contemporary legal discourse. In this, they are not infrequently used as legal references (sing. dalil) for the justification of decisions in individual cases. But what was the juridical-normative significance attributed to these legal principles within the classical Islamic legal doctrine in which they originated? Were they used as independent normative references? The purpose of this article is to address these issues. By analysing certain thematic texts, we show how one school determined the reasons for the use of legal principles in general, and their normative evidential value in particular. More specifically, the works we consulted are those of the Ottoman scholar Muhammad Abu Sa'id al-Khadimi (d. 1176/1762). In other words, this work makes no claim to generality, but does indeed argue that al-Khadimi's approach is broadly representative of the classical approach that he followed, namely the Hanafite school of legal doctrine. As a traditional scholar, al-Khadimi put an emphasis on legal principles on the eve of modernity like no other of his time. It is therefore interesting to see how his scholarship is still relevant and useful, and whether a kind of template for the use of legal principles in contemporary legal discourse can be identified.
