| Abstract | It is characteristical of teaching and studies at universities for applied science that they are practice and science orientated. Therefore the university laws of the (German) Federal states provide for a practical or sabbatical term alternatively for the professors at these universities. The practical term serves to maintain and update their practical qualification. The sabbatical term enables the professors to realize their official tasks in the field of practice related research and development. It must be ensured that a suitable teaching replacement for the subject is established during the period of the practical or sabbatical term. Article 5 section 3 and article 33 section 5 of the German Constitution guarantee the professor freedom from directive and assessment. This is why, in the process of the discretionary decision as to whether a practical or sabbatical term should be granted, previous achievements of the professor may not be taken into consideration.
