Abstract | Since the Second World War educational policy in Europe has focussed on two priorities: on equality of education and only recently on quality of education. The position of the teacher is crucial in the development of both aspects. "The legal position of the teaching profession is ... a precondition for a properly functioning education system; at the same time, this once again, illustrates the relevance and inescapable necessity of sound regulations in education. There is also unanimity concerning the importance of an apparatus for gathering objective comparative data to underpin a prospective education policy and, at the same time, to serve as a partial basis for the public debate on the education system of the future, (and thus on the legal position of the teacher)." Although the OECD and the European Commission run projects on educational policy indicators, "the juridical component, however, is missing either entirely or to a large extent. (...) The European Educational Law Association (ELA) has set itself the goal of creating an effective platform for conducting, on a comparative basis, the essential debates concerning educational law and legislation relating to education and vocational training.... The present publication examines the legal position of the teacher and also deals with the principle of mobility within the European Union. The reflection which is generated within the ELA, as well as the publication of the various papers, including the country reports, should be viewed as evidence of the readiness of legal specialists and policy- makers to be of service to their society, both at national and international level."
