Abstract	The author "describes the situation in America, which is characterized by a plurality of school districts where social - and, therefore, financial - conditions are extremely diverse. As a result, a process of 'legal regulation' of education can now be observed across the United States. Part of this process is dedicated to making the constitutional rights of students and parents, as well as teachers, practically applicable in schools, so that the legal situation of American education can be directed from this level in future." Some issues of the article are: The allocation of power among government authorities; the institutions which make or influence decisions about education (selecting the teachers, controlling the curriculum, regulating student behaviour and teacher conduct); the role of parents, teacher unions and of the local community; constraints imposed by equality requirements concerning race, sex and handicapped groups; multiculturalism in the common school.
