Abstract | The student affairs administrator needs to be legally-aware, but not legally-qualified. This article seeks to cover the key legal concepts or principles underpinning the University-Student (Business2Consumer) contract that is at the core of the University's legal relationship with its Students. It does so by exploring the leading cases setting out those concepts; some of the cases are from a higher education context, most are not. There is reference to the Consumer Rights Act 2015 as probably the most significant legislation affecting the U-S contract to educate that follows on from the contract to admit. The suggestion is made that, if administrators/managers treat Students as they would wish their relatives to be treated when in dispute or conflict with a University, the result is unlikely to be a breach of the Student's consumer protection rights (or of OfS registration conditions requiring the University to apply relevant consumer protection law).
