AbstractThe Virginia Board of Education's "Student Conduct Policy Guidelines" were first developed in 1994 in response to action by the 1993 General Assembly requiring the Virginia Board of Education to establish such guidelines. In 2004, the "Guidelines" underwent a major revision in response to requirements of § 22.1-279.6. of the Code of Virginia, and reflecting numerous changes in state and federal laws and regulations, relevant case law, and emerging best practice principles. The "Virginia Student Conduct Policy Guidelines, 2004," were originally adopted by the Virginia Board of Education on September 22, 2004. The "Guidelines" were updated in 2005, 2006, 2009, and 2013 to incorporate changes in state laws and regulations. The "Guidelines" are intended specifically to aid school boards in implementing student conduct policies. Local school boards are required to adopt and revise regulations on codes of student conduct that are consistent with, but may be more stringent than, these "Guidelines." This edition of the "Guidelines" is broken up into two parts: (1) Introduction (Background and Legal Base); and (2) Student Conduct Policy Guidelines (Elements of Student Conduct Policy, Application of Policy, Administrative Discretion, Offenses, and Related Policy Issues). The following are appended: (1) Applicable Provisions of the "Code of Virginia"; (2) Discipline of Students with Disabilities; and (3) Sample Forms and Formats; (4) Related Resources; and (5) Public Law 107-110, No Child Left Behind Act of 2001, Title IV, Part A, Section 4141, Gun-Free Requirements.
