AbstractState provisions for the education of exceptional children have become an established feature of State legislative structure. Every State makes provision for the education of extremely handicapped children in residential schools, 41 States authorize by law the inauguration of special educational facilities for exceptional children in local school districts, and 34 of these States make varying financial contributions to the maintenance of local programs. The time has come to consider the nature of these laws, what they have in common and how they differ, and what principles seem to evolve from them that may provide a guide for further developments. This report presents and analyzes the salient features of State legislation for the education of all types of exceptional children and suggests basic elements that should be included in any State legislative program of this type. While it does not deal with programs in various vocational rehabilitation agencies for handicapped adults and young people of employable age, it does involve provisions made for the education of handicapped youth in secondary schools, which may comprise specific vocational training. The study is limited specifically to instructional services and to those concomitant services which facilitate or are immediately tied up with the instructional program, and address the consideration of State provisions for the clinical study of children presenting serious problems of behavior. Sections include: (1) Some Definitions and Delimitations; (2) Exceptional Children and School Attendance; (3) Status of Residential Schools; (4) Special Education in Local School Districts; (5) State Supervision and Certification of Personnel; and (6) Conclusion: Some Basic Principles of State Legislation. An addendum notes the new State laws passed as of June 1, 1949, or amendments to existing statues. This publication gives an encouraging account of what the States have done through legislation to give to every exceptional child the educational opportunity which is his birthright.
