| Abstract | This report is the third of four volumes presenting results of the Comparative Study of Case Review Systems Phase II--Dispositional Hearings, focusing on implementation of the dispositional hearing requirement of P. L. 96-272, the Adoption Assistance and Child Welfare Act of 1980. This volume of the study presents the results of a state statutory survey of the laws in all fifty states and the District of Columbia which most closely resemble the P. L. 96-272 dispositional hearing requirement. In addition, it analyses a number of legal issues that have arisen during the implementation of this provision. The aim of the study was to provide information useful to state agencies and courts on how the hearings are functioning. On a limited basis, primarily through analysis of hearing decisions, the issue of case outcomes also is addressed. Following an introduction which describes the study background and methodology, chapters cover (1) legal issues related to dispositional hearings and (2) state statutory survey results. An extensive appendix summarizes each of the fifty states' and the District of Columbia's state statutory provisions closest to P. L. 96-272 dispositional requirements. Each summary includes the following topical areas: procedure, coverage, procedural safeguards, scheduling, authority of court, and decision required. (DST) |
