Abstract | This final report includes legal, regulatory, and statutory recommendations based upon three years of data collection, hearings, and analysis of computer-related and photocopying issues. Two major computer-related issues are addressed--the creation of new works with computer assistance, and use of copyrighted works in conjunction with computers. Three facets of the second issue are considered separately--placement into computers of copyrighted works, use of automated data bases, and copyright protection for the intellectual property in computer programs. In examining issues related to reprography the Commission focuses upon drawing a proper balance between the rights of copyright owners, and the general interests and needs of the public who rely upon photocopying as access to copyrighted works; photocopying in libraries is a major concern in this area. Appendices include a summary of the mandate of CONTU; a complete discussion of each issue relating to use of copyrighted works; a summary of legislative history relating to both issues; and a bibliography which cites selected works on computers and copyright, photocopying and the Copyright Act, and articles written by the Commission staff.
