AbstractPresented is an approach to meeting the requirements of due process in the identification, evaluation, and educational placement of handicapped children. A chapter dealing with the background, major issues, and intent of the application of due process for handicapped children focuses on the issues of exclusion and labeling and reviews state and federal statutory requirements including the Pennsylvania Association for Retarded Children (PARC) case and a federal mandate of due process (Public Law 93-380). Proposed are specific administrative due process procedures (such as written notification of parents and review of educational placement) to be used by state and local education agencies. Outlined are selection and training procedures and responsibilities of hearing officers who may be used to resolve issues between the public schools and families. Described in a final chapter is a parent surrogate approach for providing children whose parents are unavailable or unknown with adequate representation during educational decision making. Appended are 10 sample forms for organizing and administering due process (such as a request for an interpreter/translator and a referral for evaluation form). Also provided are flow charts of the evaluation and placement, request for a surrogate parent, and hearing processes. (LS)
