Abstract | Designed to be a general outline and guide for school administrators and board members, this monograph provides a broad overview of State statutes and State and Federal court decisions that affect the use and disposition of school property. The first part of the paper presents typical statutes granting to or withholding from school boards discretion to control school property use or disposition. For the sake of convenience as well as for improved analysis, the paper divides the statutes into three broad categories of community use of school property, general purpose use, and use at board discretion; however, the similarities among these categories become readily apparent. Highlighting trends in recent court decisions and the issues involved, the second part of the monograph covers case analyses and clarification of State statutes in the areas of tort liability, leasing and selling, deed clauses, and constitutional issues.
