Abstract	Die Formulierung eines Grundrechts auf "schulische Bildung" durch das BVerfG, und zwar als "Gewährleistungspflicht" des Staates für einen "unverzichtbaren Mindeststandard schulischer Bildung" wird im Beitrag als gravierende Zäsur in der bisher ein Grundrecht auf Bildung eher abwehrenden Rechtsprechung des Gerichts und der meisten Kommentatoren gewürdigt. Das neue Grundrecht wird zugleich in die seit dem 19. Jahrhundert konstante und breite Diskussion über das "Grundrecht auf Bildung" als Recht auf ein "obligatorisches Bildungsminimum" gestellt. Vom Status des Rechts als "derivatives", "subjektives Leistungsrecht" aus werden schließlich die Anschlussfragen und Handlungsmöglichkeiten für Bildungspolitik, Rechtswissenschaft und Bildungsforschung diskutiert. The formulation of a fundamental right to "school education" by the Federal Constitutional Court, namely as a "guarantee obligation" of the state for an "indispensable minimum standard of school education", is appreciated in the article as a serious caesura in the case law of the court and most commentators, which has so far tended to ward off a fundamental right to education. At the same time, the new fundamental right is placed in the constant and broad discussion since the 19th century about the "fundamental right to education" as the right to a "compulsory minimum education". From the status of law as a "derivative", "subjective performance law", the follow-up questions and handling options for educational policy, jurisprudence and educational research are finally discussed."
