| Abstract | Die Autoren wenden sich speziell dem Hochschulrat zu in dem Bestreben, die Kompetenzstruktur zwischen Hochschulrat und Hochschulleitung möglichst fassbar zu machen und einzuhegen. (HoF/Text übernommen). The university council has to advise and supervise the university management. In certain strategically important decisions the council has the right of codecision. Furthermore, it decides on the election and deselection of members of the university management. In all, the extensive authority of the university council coupled with the reduction of the senate's authority meets with grave constitutional concerns. Regardless of this, the advice of the university council is not binding and is only required when making strategically important decisions, not however in answering concrete individual questions that occur during daily business. The university council's codecision power is limited to the basic planning aspects and may not be used to influence the operative management assigned to the university management nor indeed to directly influence concrete questions of research and teaching. In this respect, the university council can neither give binding instructions to the university management nor can it revise the university management's decisions. An efficient form of legal supervision must be guaranteed by the competent ministry that must also be informed in the case of serious complaints. The authority to vote individual members of the university management out of office may not be abused by the university council in order to transform their powers of consultation and supervision into an indirect power of authority.
