AbstractThis statement of the enforcement of child day care licensing standards identifies basic concepts of the enforcement process and operational procedures necessary to bring about this process. Two types of enforcement operations, negative and positive enforcement of standards, are identified and examined in detail. Positive enforcement is defined as a program of regulatory investigation-inspection (supervision) designed to provide a support service to licensees so there is continuance of conformity to standards after licensure. A discussion of negative enforcement focuses briefly on denial of application (refusal by a regulatory agency to give an applicant permission to operate) and non renewal (denial of a reapplication for a license). Discussed in greater detail is revocation, the official termination of previously granted approval to operate in an otherwise legislatively closed area of activity. Finally, the structural aspects of enforcement are treated with respect to administrative organization of licensing operations, personnel administration aspects of enforcement, and the role of the federal government in enforcement of state licensing standards. Four appendices supplement the text by presenting materials related to licensing enforcement: statutory basis, administrative procedure act, relationships between the licensing agency and the attorney general's office, and the suppression of illegal operations.
