Abstract | For decades, university capacities were extended in order to meet the demand for university places. Although the demand has not decreased, since the mid-eighties, university capacities have continuously been reduced again in numerous courses of studies. In the beginning, this happened by transfering placements to other courses of studies and by changing tuitional and capacity legislation. Now, the reduction of university capacities is carried out on the basis of budgetary guidelines from the Federal state legislator or also by prescribing the capacities to be aimed at by law. The administrative courts view reduction of capacity critically, whereas the Constitutional court seems to approve of it. The reduction of university capacities requires a proper justification, the universities concerned have to be granted a punctual hearing, the different interests of the state, the university and the university applicants have to be weighed up and finally, when courses of studies are concerned which not all Federal states offer, the respective states have to come to an arrangement with the other Federal states.
