| Abstract | The article examines the law of special education needs in the United States and England, with a primary focus on the power of local education authorities to determine the child's level of provision. The American courts have drawn a close link between education and equality, with the result that thas law concentrates on the legal rights of the child ... Children have rights that can be asserted against local educational agencies. By contrast, the English system does not recognize a right to education, or even a right of equal access to educational services. Instead, the Englishh system of special education operates by imposing specific duties on local authorities.... This article explains that the reasons for these differences can be found partly in differences in the constitutional structure of each country. The English system tends to favor the benefits of education to the public generally, rather than the entitlement of any given child; moreover, it does not place as much importance on the link between educational access and participation in the political life of a republic as does the American system. Finally, in terms of political structures, the English courts place far more trust in local education authorities than do the American courts. (DIPF/Abstract übernommen). |
