Abstract	The author raises a hypothetical issue in response to Lenaerts' paper (another contribution in this volume "Subsidiarity and education") in order to bring up some of the implications and difficulties in the legal position Lenaerts outlined." It relates to the possibility of the Community, building on its efforts to date, taking action to promote educational initiatives in Member States which are sensitive to the special needs of E. C. migrant workers and their families. It is hoped in examining the possibility of such an initiative to assess the relationship of Articles 3b, 49 and 126 of the European Community Treaty." (...) "Migrant workers and their families will almost inevitably form a minority in their host Member State.... It may be the case that attempted restrictions of the definition of a minority to indigenous groups would place them formally outside the scope of some of the relevant legal documents, but the kinds of difficulties they can experience in educational systems cannot be denied."
