| Abstract | The purpose of this paper is to review briefly the major federal and state cases dealing with fiscal equalization in state school support programs and to discuss, in depth, the conflicting rulings in the state courts, with particular attention given to the problems created by use of the "thorough and efficient" concept in Robinson v. Cahill. In this case, the court found that the New Jersey state school finance system discriminated against pupils in poor districts and also discriminated against taxpayers by imposing an unequal burden for public education. The paper concludes that it is extremely difficult to analyze state school fiscal equalization decisions and accurately predict how a court in another state will rule in a similar situation. It predicts that the weight of the federal cases, coupled with recent decisions rejecting attacks on state school finance systems, will inhibit many state courts from entering the confusing world of fiscal equalization of educational opportunity.
